Mit dem am 21. November in Kraft getretenen Kohlendioxid-Speicherungs- und Transportgesetz (KSpTG) hat Deutschland erstmals einen rechtlichen Rahmen für Carbon Management geschaffen. Zugleich zeigt sich, dass dieser bislang nicht ausreicht, um Unternehmen zu belastbaren Investitionsentscheidungen zu befähigen. Der zentrale Grund hierfür ist ein strukturelles Koordinationsproblem: Industrie, Infrastruktur- und Logistikanbieter sowie potenzielle Speicherbetreiber warten gegenseitig auf verbindliche Zusagen.
Vor diesem Hintergrund steht der Hochlauf einer funktionierenden CO₂-Wertschöpfungskette vor grundlegenden Herausforderungen. Unklar ist weiterhin, welche Infrastruktur entlang der gesamten Kette tatsächlich benötigt wird, warum Emittenten, Logistik- und Speicherbetreiber bislang im gegenseitigen Abwarten verharren und ob der bestehende regulatorische Rahmen – insbesondere das KSpTG – ausreichende Planungs- und Investitionssicherheit bieten kann.

With the Carbon Dioxide Storage and Transport Act (KSpTG), which came into force on November 21, Germany has created a legal framework for carbon management for the first time. At the same time, it is clear that many market players believe this framework is not yet sufficient to enable the transition from political objectives to reliable investment decisions. The main reason for this is a structural coordination problem: industry, infrastructure and logistics providers, and potential storage operators are all waiting for binding commitments from each other.
Against this backdrop, the ramp-up of a functioning CO₂ value chain faces fundamental challenges. It remains unclear what infrastructure is actually needed along the entire chain, why emitters, logistics and storage operators have so far remained in a state of mutual waiting, and whether the existing regulatory framework – in particular the KSpTG – can offer sufficient planning and investment security.
These topics are the focus of the upcoming webinar hosted by the Carbon Management Alliance:
